NPA takes disciplinary action against the prosecutor arrested for contempt

The National Prosecuting Authority (NPA) is initiating disciplinary proceedings against a prosecutor convicted of contempt of court at the Kwaggafontein Magistrates Court in Mpumalanga on Monday, 18 May 2026.

The individual will be suspended pending the outcome of the internal inquiry.

The disciplinary action follows the prosecutor’s failure to attend a bail hearing for State v Madoda Johannes Sibanyoni and Others, a high-profile case involving charges of extortion and money laundering.

Due to the prosecutor’s absence, the magistrate struck the matter off the court roll and authorised a warrant for his arrest.

Consequently, the case can now only be reinstated with written authorisation from the Director of Public Prosecutions (DPP) for the Mpumalanga Division.

While acknowledging the magistrate’s prerogative to invoke the Criminal Procedure Act, the NPA is reviewing the order to determine if it was the most appropriate legal mechanism for the situation.

Meanwhile, the DPP is collaborating with the South African Police Service (SAPS) investigating officer to facilitate the prompt re-enrolment of the charges.

The National Director of Public Prosecutions (NDPP), Adv Andy Mothibi, expressed shock and dismay over the incident, appealing to the public for patience during the internal and external investigations.

He emphasised that the situation is not a permanent setback, reassuring the public that the NPA remains resolute in its constitutional duty to hold the accused accountable without impunity.
